Court Rules Obama Abused Power

Sean spent the entire second hour of Friday's show talking with Juan Williams and Ann Coulter about a range of topics. Sean started out by discussing the breaking news of the federal appeals court invalidating Obama's recess appointments of NLRB members. The court ruled Obama abused his powers and acted when the Senate was not actually in a recess. "Allowing the president to define the scope of his own appointments power would eviscerate the Constitution’s separation of powers," the judges said in their opinion. Ann surprised Sean by siding with Juan on the issue. "I think they will appeal this pretty quickly to the Supreme Court," Juan said to Sean. "The idea that the Senate is saying 'we're never in recess' is pretty extreme. And I'm not sure this is the way the system is intended to work," Juan added. Reporter's Personal Agenda To Attack Fox News Earlier today Sean tweeted out a story about a reporter with a personal agenda against Fox News. John Lott, writing for Breitbart.com described how Gabriel Sherman of New York Magazine began asking Lott about the media coverage of the Newtown school shootings. Sherman took a quote out of context from Lott and wrote about how Fox News had shown warmth toward gun control and had "shut down" Lott based on Rupert Murdoch's policy preferences. "I don't know Murdoch; I've never met him. There's no possible way I could have commented on such decisions," said Lott. "Instead of reporting what I told him, he drew a picture of Fox News shutting down debate about gun control. That was precisely the opposite of what I had said: indeed, I had told Sherman that I wished other networks would do what Fox did and not launch into debates about gun control the day of an attack, before we could possibly know the facts about what had happened. Does Obama's 2nd Term Agenda Include Annihilating The GOP? It is a speech that is being hailed as the most liberal and progressive inaugural address in decades with themes including gun control, climate change, gay marriage and immigration - President Obama's inaugural address outlined an agenda that will undoubtedly be faced with severe push-back from Republicans. The conversation turned to the topic of wealth distribution. "I will tell you to have a 40 percent rate on the highest income, as it was in the '90s, plus the average state tax rate of I think five percent, that's, A, that's one of the lowest rates on high income people that we've had over the last 65 years, the share of income of people in the top 400 people's income getting paid to the federal government is the lowest it's been in 25 years.
